1. Service / Hizmet

WhatsApp by MTO ("the Service") is a WhatsApp Business Platform messaging service operated by MTO Management (digital@mtomanagement.com). The Service enables brands ("Clients") to send template-based WhatsApp messages — such as order notifications and marketing campaigns — to end users who have explicitly opted in.

WhatsApp by MTO ("Hizmet"), MTO Management tarafından işletilen bir WhatsApp Business Platform mesajlaşma hizmetidir. Markaların, açık rıza vermiş kullanıcılara şablon tabanlı WhatsApp mesajları göndermesini sağlar.

2. Acceptable use / Kabul edilebilir kullanım

• Messages may only be sent to recipients with a recorded, timestamped opt-in. / Mesajlar yalnızca kayıtlı ve zaman damgalı rızası bulunan alıcılara gönderilir.
• Clients must comply with the WhatsApp Business Messaging Policy, Meta Platform Terms, and applicable law including Turkish KVKK and ETK. / Müşteriler WhatsApp Business Mesajlaşma Politikası, Meta Platform Koşulları ve KVKK/ETK dahil yürürlükteki mevzuata uymakla yükümlüdür.
• Spam, harassment, deceptive content, and messaging without consent are prohibited and result in suspension. / Spam, taciz, yanıltıcı içerik ve rızasız mesaj gönderimi yasaktır; tespitinde hizmet askıya alınır.
• Opt-out requests are honored immediately. / Çıkış (opt-out) talepleri derhal uygulanır.

3. Fees / Ücretler

Message delivery is charged per delivered message according to Meta's current rate card plus the service fee agreed with the Client. / Mesaj teslimi, Meta'nın güncel tarifesine ve müşteriyle anlaşılan hizmet bedeline göre ücretlendirilir.

4. Liability / Sorumluluk

The Service depends on the WhatsApp Business Platform; MTO Management is not liable for delivery failures, delays, or limitations imposed by Meta (including quality ratings and per-user message limits). The Service is provided "as is" to the extent permitted by law.

5. Data / Veri

Personal data is processed as described in our Privacy Policy. / Kişisel veriler Gizlilik Politikamızda açıklandığı şekilde işlenir.
